Thank you for visiting www.monnait.com. These terms and conditions apply to your use of www.monnait.com and associated sub-websites that we own and maintain. We are 5 Dare Limited ("Monnait"), registered in Hong Kong, with registered office at Room 1010, 10/F, W50, 50 Wong Chuk Hang Road, Wong Chuk Hang, Hong Kong.
By accessing or using this website, placing an order, or otherwise engaging with our services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use this website.
1. General
1.1. These Terms and Conditions, together with our Privacy Policy and Shipping & Returns Policy, govern your use of the Monnait website and your purchase of products from us.
1.2. We reserve the right to update or modify these Terms at any time without prior notice. Changes will be effective immediately upon posting to the website. Your continued use of the website constitutes acceptance of the revised Terms.
1.3. These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any disputes shall be subject to the exclusive jurisdiction of the courts of Hong Kong.
2. Eligibility
2.1. You must be at least 18 years of age, or the age of majority in your jurisdiction, to make a purchase on this website.
2.2. By placing an order, you represent and warrant that you are legally capable of entering into binding contracts.
3. Products and Descriptions
3.1. All products are subject to availability. We reserve the right to discontinue any product at any time without notice.
3.2. We make every effort to display our products and their colors, textures, and finishes as accurately as possible. However, as the appearance of products may vary depending on your device and screen settings, we cannot guarantee that your display will accurately reflect the actual product.
3.3. Product images are representative. Minor variations in color, texture, and finish are natural characteristics of handcrafted jewelry and do not constitute defects.
3.4. "Estimated Retail" values displayed on product pages are our good-faith estimates of comparable retail pricing based on similar products from traditional luxury retailers. These values are provided for reference and comparison purposes only and do not represent a previous selling price.
4. Pricing and Payment
4.1. All prices are listed in US Dollars (USD) unless otherwise stated. Prices may be displayed in local currency equivalents for your convenience; however, the USD price at the time of purchase is the binding price.
4.2. Prices are subject to change without prior notice. The price applicable to your order is the price displayed at the time the order is placed.
4.3. We accept payment via major credit cards (Visa, Mastercard, American Express), Apple Pay, Google Pay, Shop Pay, and PayPal. All payments are processed securely through our payment partners.
4.4. Your payment will be authorized and charged at the time of purchase. Orders will not be shipped until payment has been received in full.
4.5. In the event of a pricing error, we reserve the right to cancel any orders placed at the incorrect price and will notify you promptly. We will issue a full refund for any cancelled orders.
5. Orders and Acceptance
5.1. Placing an order on our website constitutes an offer to purchase. All orders are subject to acceptance by us.
5.2. We reserve the right to refuse or cancel any order for any reason, including but not limited to: product unavailability, errors in pricing or product information, suspected fraud, or orders that appear to be placed by resellers or dealers.
5.3. An order confirmation email does not constitute acceptance of your order. Acceptance occurs when the product is dispatched and a shipping confirmation email is sent.
5.4. We reserve the right to limit the quantity of products purchased per customer or per order.
6. Shipping and Delivery
6.1. Please refer to our Shipping & Returns page for detailed information on shipping destinations, costs, and estimated delivery times.
6.2. Delivery times are estimates only and are not guaranteed. We are not liable for delays caused by shipping carriers, customs processing, weather, or other factors beyond our control.
6.3. Risk of loss and title to products pass to you upon delivery to the shipping carrier.
6.4. It is your responsibility to provide accurate and complete shipping information. We are not responsible for orders shipped to incorrect addresses provided by the customer.
6.5. Refused packages and those that are not received due to negligence on the part of the recipient (e.g., mistyped address) will be refunded once received by our warehouse, less the cost of shipping to and from the destination country, as well as any applicable duties and taxes.
7. Returns and Exchanges
7.1. Please refer to our Shipping & Returns page for our full return and exchange policy.
7.2. Eligible items may be returned within 30 days of delivery. Items must be unworn and in original condition, including all original packaging.
7.3. A repackaging fee of $8.97 will be deducted from refunds to cover return handling costs.
7.4. Solid gold pieces (10k and 14k) are handmade to order and cannot be returned for a refund. Exchanges for a different size are available within 30 days of delivery.
7.5. Customized, engraved, or personalized items, and items marked "Final Sale" on the product page, are not eligible for return or exchange.
7.6. Shipping fees paid at the time of purchase are non-refundable.
7.7. Refunds will be processed to the original payment method within 5–7 business days of receiving the returned item.
8. Warranty
8.1. All Monnait products are covered by a lifetime warranty against manufacturing defects. Please refer to our Warranty page for full details.
8.2. The warranty covers manufacturing defects in materials and craftsmanship, including loose or missing stones due to setting failure, broken clasps or closures under normal use, and structural failure.
8.3. The warranty does not cover normal wear and tear, damage from impact, chemicals, or improper care, loss or theft, or modifications made by third parties.
9. Intellectual Property
9.1. All content on this website — including but not limited to text, images, photographs, graphics, logos, icons, product designs, page layouts, and software — is the property of 5 Dare Limited or its licensors and is protected by copyright, trademark, and other intellectual property laws.
9.2. You may not reproduce, distribute, modify, display, transmit, or use any content from this website for any commercial purpose without our prior written consent.
9.3. The Monnait name, logo, and all related marks are trademarks of 5 Dare Limited. Unauthorized use of these marks is strictly prohibited.
10. User Accounts
10.1. You may be required to create an account to access certain features of the website. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
10.2. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

12.2. Our total liability to you for any claim arising from these Terms or your use of the website or products shall not exceed the amount you paid for the product(s) giving rise to the claim.
12.3. Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law.

You agree to indemnify, defend, and hold harmless 5 Dare Limited, its directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to your breach of these Terms, your use of the website, or your violation of any law or the rights of any third party.

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, pandemics, war, terrorism, strikes, government actions, power failures, internet or telecommunications failures, or carrier delays.
16. Severability
16.1. If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy and Shipping & Returns Policy, constitute the entire agreement between you and 5 Dare Limited with respect to your use of the website and purchase of products, and supersede all prior or contemporaneous communications, whether electronic, oral, or written.

18.1. No failure or delay by us in exercising any right under these Terms shall constitute a waiver of that right. A waiver of any right on one occasion shall not be deemed a waiver of that right on any subsequent occasion.
